We do not guarantee that our site, or its content, will always be available or be uninterrupted. We may suspend, withdraw or restrict the availability of all or any part of our site for business and operational motives.

By using our site, you confirm that you accept these terms of use and that you agree to comply with them. If you do not agree to these terms, you must not use our site.

We may update and change our site now and then to replicate changes to our products, our guests’ requirements and our business priorities.

The content on our site is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our site.

The use of any part of the content on our site for commercial purposes is restricted without legal consent to do so from YELLOW UMBRELLA™.

Printed copied,  or downloaded materials from any part of our site is a breach in our terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

 We do not guarantee that our site will be secure or free from bugs or viruses. You are responsible for your computer its programs and software and should use your own virus protection software.

The misuse of our site knowingly introducing viruses or other material that is malicious or technologically harmful. You must not attempt to gain unauthorized access to our site, the server on which our site is stored or any server, computer or database connected to our site. By breaching these terms, you are committing a criminal offence and will be reported to the Bureau of Investigation / Cyber Crime.

Itineraries and Pricing may be personally compared however distribution to third parties by individuals, customers or third party travel agents is a serious breach of copyright infringement and would attract legal action. 

Booking

By booking a Tour or Service offered by the YELLOW UMBRELLA™ you acknowledge that you have read, understand and agree to be bound by these Terms. If you make a booking on behalf of other participants, you guarantee that you have the authority to accept and do accept these Terms on behalf of the other participants in your party.

Your booking is confirmed and a contract exists when the YELLOW UMBRELLA™ issues a written confirmation after receipt of the applicable deposit amount. Please check your confirmation carefully and report any incorrect or incomplete information to the Tour Operator or authorized agent immediately. Please ensure that names are exactly as stated in the relevant passport.

You must be at least 18 years of age to make a booking. You agree to provide full, complete and accurate information to the Tour Operator.

The YELLOW UMBRELLA™ reserves the right to deny you permission to travel or participate in any aspect of a Tour or Services offered at any time and at your own risk and expense when a customer’s physical or mental condition is rendered unfit for travel or represents  a danger to his / herself or others.

At the time of booking, you must provide the information requested by the YELLOW UMBRELLA™ along with final payment. If you fail to supply information required for air tickets, permits, or other inclusions, you will also be liable for any costs, fees or losses including failure to obtain or provide that inclusion. In the event that you fail to supply the information required the YELLOW UMBRELLA™ reserves the right to treat your booking (or the relevant component of your booking) as cancelled and levy any cancellation fees deemed reasonable. The information required will vary by Tour, Product or Service and will be communicated to you or to the YELLOW UMBRELLA™ or its authorized agent during the booking process. The YELLOW UMBRELLA™ will not be held responsible for any fees you incur as a result of errors, omissions, inaccuracies, late, misplaced or any incomplete information you have provided.

You must provide any medical information reasonably requested by the YELLOW UMBRELLA™ .Medical Forms are mandatory for certain Tours. If you have any pre-existing medical conditions which may impact your ability to travel, participate in a Tour or service, travel to remote areas without access to medical facilities or may adversely affect the experience of others on your Tour, you must return a Medical Form, signed by a licensed and practicing physician to the Tour Operator prior to or at the time of final payment for the applicable booking.

You agree to complete the Medical Form honestly and to disclose all relevant medical information accurately and fully. The YELLOW UMBRELLA™ will maintain the information in accordance with our Privacy Policy.

Pregnancy is considered a medical condition and must be disclosed at the time of booking. The YELLOW UMBRELLA™ may refuse to carry women who are over 24 weeks pregnant and may refuse to carry anyone with certain medical conditions if reasonable accommodation or alternatives cannot be arranged.

The YELLOW UMBRELLA™ reserves the right to request further information or professional medical opinions where necessary, as determined in its discretion, for your safety or the safe operation of a Tour or Service.

In the event that you do not complete the required Medical Form or provide medical information reasonably required by the YELLOW UMBRELLA™ for any reason by the given deadline the YELLOW UMBRELLA™ reserves the right to cancel your booking and all applicable cancellation fees will apply.

You are responsible for assessing whether a Tour is suitable for you. You should consult your physician to confirm your fitness for travel and participation in any planned activities. You should seek your physician’s advice on vaccinations and medical precautions. It is your responsibility to assess the risks and requirements of each aspect of the Tour based on your own unique circumstances, limitations, fitness level and medical requirements.

Travel with the YELLOW UMBRELLA™ may involve visiting remote or developing regions, where medical care may not be easily accessible The YELLOW UMBRELLA™ Tour makes no representations and gives no warranties in relation to the availability or standard of medical facilities in those regions.

Any special requirements must be disclosed to the YELLOW UMBRELLA ™ at the time of booking. We will use reasonable efforts to accommodate special requirements or requests but this is not always possible given the nature of the destinations visited and availability of options outside a planned itinerary for our Tours or Services. Certain activities may be inaccessible to you if your mobility is limited in any way. All food allergies and dietary restrictions must be disclosed at the time of booking but the YELLOW UMBRELLA™ cannot guarantee that dietary needs or restrictions can be accommodated. Any special requests or requirements do not form part the contract between you and the YELLOW UMBRELLA™ and the YELLOW UMBRELLA™ is not liable for any failure to accommodate or fulfill such requests.

Anyone under the age of 18 on the date of first travel is considered to be a minor. Minors must always be accompanied by an adult. One adult may accompany up to two minors. Unless otherwise indicated in the Tour or Service description or by the YELLOW UMBRELLA™.

All bookings with a minor are subject to review and approval by the YELLOW UMBRELLA™. If the consent of a parent, guardian or any other person is required by applicable law for any minor to travel, the accompanying adult is responsible for securing all consents, documentation and ensuring that they and the minor(s) meet all legal requirements to travel, to enter into and depart from applicable countries and regions. The Tour Operator will not be responsible for any fees, damages, or losses incurred as a result of any failure to secure necessary consents, permits, and approvals.

Each adult on a booking with a minor or minor(s) is jointly and severally responsible for the behavior, wellbeing, supervision and monitoring of such minor(s), and jointly and severally accepts these Terms for and on behalf of any minor(s) on their booking, including all assumptions of risk and limitations of liability. The YELLOW UMBRELLA™ does not provide care services for minors and expressly disclaims any responsibility for chaperoning or controlling any minor(s).

YOU MUST HAVE TRAVEL INSURANCE WITH A MINIMUM MEDICAL, EVACUATION AND REPATRIATION COVERAGE OF US$200,000 covering all applicable dates of travel with the YELLOW UMBRELLA™. This insurance must cover personal injury and emergency medical expenses.  You are strongly recommended to extend your coverage to include cancellation, curtailment, and all other expenses that may arise as a result of loss, damage, injury, delay or inconvenience while traveling. You acknowledge that insurance coverage is not included in the cost of any Tour or Service offered by the YELLOW UMBRELLA™ and you are required to obtain separate coverage at an additional cost. It is your responsibility to ensure that you have sufficient coverage and comply with the terms of the applicable insurance plans. You are responsible for advising your insurer of the type of travel, destination(s), services and activities included in your booking so that the insurer may provide appropriate coverage.

All dates, itineraries and prices of Tours and Services are subject to change at any time and the current price will be quoted and confirmed at the time of booking

You acknowledge that you are responsible for keeping up to date on the specific details of your Tour and any other products or services, and checking the YELLOW UMBRELLA™ website at least 48 hours prior to departure as minor changes may have been made after the time of booking.

Tour prices do not include international or other airfare unless mentioned in the Tour description. The YELLOW UMBRELLA™ will quote the best price available for the travel dates requested at the time the quote is prepared. Quotes provide an estimate only and are not a firm price commitment by the Tour Operator or the applicable air carrier(s).

The YELLOW UMBRELLA™ acts only as a sales agent for the applicable air carrier and the air carrier terms and conditions apply to the purchase and use of the air travel ticket. Please consult the air carrier’s applicable terms and conditions and conditions of carriage for complete information including applicable cancellation terms. The YELLOW UMBRELLA™ is not responsible for changes in air itineraries or flight times and does not provide advice or alerts regarding air travel tickets, flight status or delays.

YELLOW UMBRELLA™ is in no way liable and responsible for Loss of Personal Property or Life due to Mishaps, Accidents, Natural Disasters, Medical emergencies, Theft etc. Liabilities for such incidents must be covered by the travelers insurance companies.

Complaints for Personal and petty grievances ( room change ,Meal preference etc.) may be reported to YELLOW UMBRELLA™ Customer Care +919330975956 who will try and resolve your complaint. Serious and Life threatening issues and complaints may be reported to the local authorities directly without hesitation or delay. 

Cancellations

YELLOW UMBRELLA™ is a TOUR OPERATOR that uses the services of various affiliate Travel, Transport and Hospitality agencies and thus follows the Cancellation Policies and regional tax norms of those agencies specific to the booked tour. In case of cancellation within 90 Days of travel date, deposit fees and cancellation charges may be withheld by YELLOW UMBRELLA™ to be paid to our affiliate agencies the remaining payment will be refunded. 

 You may cancel your booking by notifying the YELLOW UMBRELLA™. Cancellation fees, if any, will be determined with reference to the date on which notice of cancellation is and are expressed as a percentage of the total price paid for the cancelled Tour, product or service (excluding any insurance products).

Cancellation received 60 days or more before commencement date of product or service in relevant booking: The minimum Cancellation Deposit will be withheld in accordance with these Terms, the remainder of the payments made to the Tour Operator in respect of the cancelled product will be refunded. (Cancellation deposits will be used to refund affiliate agencies their minimum cancellation fees and vary with specific tours, products and services)

 Cancellation received 30-59 days before commencement date of a Tour, Product or Service in relevant booking: Cancellation deposit will be withheld by the YELLOW UMBRELLA™ in accordance with these Terms, an amount equal to 50% of the remainder of the payments made in respect of the cancelled Tour, Product or Service will be refunded.

 Cancellation less than 30 days before commencement date of a Tour, Product or Service in relevant booking: Cancellation Deposit will be withheld in accordance with these Terms, and no further refund will be payable.

For certain tours, products or services offered by the YELLOW UMBRELLA™, alternative cancellation terms may apply. The YELLOW UMBRELLA™ will advise you of any such requirements prior to confirmation of the applicable booking.

The Tour Operator guarantees that all scheduled Tour departures booked and secured with a valid deposit will depart as indicated on the applicable confirmation, subject to reasonable itinerary changes as described in these Terms or good faith health and safety concerns. This guarantee is not applicable in the case of Force Majeure. Up to date Tour information is available on the website or by contact Brochures and other printed materials displaying Tour information and departure dates are subject to change may not be relied upon for purposes of this guarantee.

If a Tour, Product or Service is cancelled by the YELLOW UMBRELLA™ before the commencement date for reasons other than Force Majeure and the cancellation is not caused by your fault or negligence, you will have the choice of accepting a substitute Tour, Product or Service of equivalent or superior value; or a substitute Tour, Product or Service of lesser value if no Tour of equivalent or superior value is reasonably available and to recover from the YELLOW UMBRELLA™ the difference in price between the price of the Tour originally purchased and the substitute Tour; or a full refund of all monies paid for the cancelled Tour.

The YELLOW UMBRELLA™ is not responsible for any incidental expenses or consequential losses that you incur as a result of the cancelled booking including visas, vaccinations, non-refundable flights or rail, non-refundable car parking or other fees, loss of earnings, or loss of enjoyment, the YELLOW UMBRELLA™ reserves the right to issue a full refund in lieu of the choices above, in its sole discretion. Where a significant element of a Tour, Product or Service as described cannot be provided after departure, the YELLOW UMBRELLA™ will make suitable alternative arrangements where possible. If it is not possible to provide a suitable alternative or if you reasonably reject any suitable alternatives, the YELLOW UMBRELLA™ may provide you with a refund for unused products or services as determined in its discretion.

The YELLOW UMBRELLA™ its subsidiaries and their respective employees, affiliates, officers, directors, successors, representatives, and assigns shall not be held liable for (A) any damage to, or loss of, property or injury to, or death of, persons occasioned directly or indirectly by an act or omission of any other provider, including but not limited to any defect in any aircraft, watercraft, or vehicle operated or provided by such other provider; and (B) any loss or damage due to delay, cancellation, or disruption in any manner caused by the laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent thereof, or by acts of God, strikes, fire, flood, war, rebellion, terrorism, insurrection, sickness, quarantine, epidemics, theft, or any other cause(s) beyond their control. You waive any claim against the YELLOW UMBRELLA™ for any such loss, damage, injury, or death.

COVID-19 TRAVELER T & C’s

Travelers must ensure their own personal protection is maintained by carrying a COVID- 19 Protection Pouch. (Hand sanitizer under 100ml, latex gloves, protective mask).

Travelers are subject to any imposed medical protocols on arrival at pick up location.

If found with flu like symptoms and COVID Positive on Arrival the Traveler will bear the expenses of Medication, Quarantine and Return formalities.

Travelers must report the development of any Flu like Symptoms on self or members of Family or Group immediately to the Tour Operator during the tour. If Covid Positive the expenses will be borne by the Traveler or Travelers themselves. 

Medical, Travel and Personal Insurance is mandatory and solely procured by the travelers to avoid unforeseen personal expenses in case of illness or medical emergencies.

Travelers are requested to follow the instructions and guidance of the Tour Staff when visiting Public locations and sites during sightseeing.

Every Hotel, Guesthouse and Accommodation have guidelines set up in accordance with the layout of the property Travelers are requested to kindly cooperate while inside their property.

Family, Friends or Members of a group who personally know each other may travel as part of one group in the same vehicle.

A Traveler may opt for a shared vehicle that operates with proper distancing guidelines.

Travelers may report any deviation by Drivers, Hotel Staff or Public sites staff to the Tour Operator who will report a statement of negligence.

Travelers are requested to kindly respect the decisions made by the Tour Operator if done so in the interest of Public Safety.

The Tour Operator may terminate the Tour if any member or group fail to comply with the general guidelines, demonstrate obscene or threatening behavior, show signs of disrespectful gestures and language towards the cultures and traditions of the local people.

Travelers are solely responsible for their children and personal possessions at all times.

Due to the ongoing Pandemic sightseeing itineraries are subject to change for the health and safety of the Travelers, Tour, Transport and Hotel staff and the general public.
